Disciplinary rules are a separate type of law. Unlike in civil law and tax law, disciplinary law focusses on the interpretation of a single, sometimes legal, standard rather than on an entire legal system. Disciplinary law mainly concerns the question whether the lawyer or civil-law notary involved acted ‘befittingly’, or not. This is an open standard that is constantly evolving.
Huan Tan, in his time as dean of the Utrecht District Bar Association, has gained a lot of knowledge and experience in disciplinary rules and supervision. He is now a member of the Arnhem-Leeuwarden jurisdiction Board of Discipline (for the legal profession). Since his arrival disciplinary law has become a field of specific interest at Benvalor.
